NH School Scoop Special Edition - April 24, 2025
A NH federal judge believes that the Trump Administration has not adequately defined "diversity, equity, and inclusion."
In a decision with national implications, NH federal court judge Landya B. McCafferty limited the Trump Administration’s power to withhold funds from public schools with DEI practices. The US Department of Education expressed its policy change through its “Dear Colleague” letter from February 14.
Judge McCafferty stated that the Administration’s current policy may restrict free speech in the classrooms, overstep the executive branch’s authority over schools and that the loss of federal funding may “cripple the operations of many educational institutions.”
The decision does not apply to all US schools. Instead, the ruling is limited to schools employing or contracting with the plaintiffs in the case, the National Educational Association and the Center for Black Educator Development.
The Administration is expected to appeal.
